Specialty Mississippi License Plates

MEMORANDUM

TO: ALUMNI AND FRIENDS OF THE UNIVERSITY OF ALABAMA IN THE STATE
OF MISSISSIPPI

WHAT AND WHY:

The Mississippi Legislature has approved the issuance of “out of state
University license plates” for vehicles titled in Mississippi. Members
of the University of Alabama Alumni Associations around the State of
Mississippi have inquired of the Mississippi State Tax Commission to
acquire information about the process to have a University of Alabama
affiliated license plate approved. Based upon those discussions,
residents of the State of Mississippi who are alumni and/or friends of
the University of Alabama may now participate in the “qualification
process” that may lead to the approval of such a license plate.

The Mississippi legislature established a requirement that, before an
out of state university plate may be approved for manufacture and
issuance, there must be at least 200 completed applications for this
specialty plate, as well as, a corresponding number of “prepaid
specialty tag fees.” Mississippi charges $51 annually for the privilege
of a specialty tag, and this fee is in addition to the ad valorem tax
levied on your vehicle. Once 200 applications are completed, and a
total of $10,200 in prepaid specialty tag fees are collected, the State
Tax Commission will authorize the development of the specialty tag.

The State Tax Commission requires each institution or group seeking to
have a specialty tag approved to designate one individual to serve as
the “repository” for the collection of all applications and prepayment
fees. This prevents the Tax Commission from having to deal with 200 or
more different people in this process. Solely for the purpose of
organization and efficiency, the Jackson Chapter of the University of
Alabama Alumni Association has asked a local attorney and graduate of
the University’s Law School, Craig Slay, of the Adams & Edens Law Firm
in Brandon, to serve as the collector. Because Craig’s firm has a trust
account, the prepayment fees collected can be deposited in escrow while
the target number of applications are collected. Assuming this process
successfully yields the target number of 200 applications and prepaid
fees, Craig will remit one check to the State Tax Commission for the
required prepayment deposit.

HOW:

Your participation is quite simple. With this communication, we have
provided a link to the actual specialty tag application that you will
need to complete and mail to Craig Slay, along with your check for the
prepayment fee(s). You will need to complete a separate application for
EACH VEHICLE for which you seek a specialty tag. Please print an
application for each vehicle tag you intend to purchase, complete it
fully, and remit, along with your check covering the $51 specialty tag
fee for each application you tender. For clarity, if you want to buy a
specialty tag for each of your two vehicles, for instance, you will need
to submit two applications, one for each car, and you will need to remit
$102 to cover the $51 specialty tag fee for each vehicle’s specialty
plate. THIS IS VERY IMPORTANT: YOUR CHECK SHOULD BE MADE PAYABLE TO
ADAMS & EDENS, P.A., TRUST ACCOUNT, and you should place a notation in
the memo line of your check that reads, “University of Alabama Specialty
Tag Fee.” This is an escrow account, meaning the funds remain your
possession until the target number of applications is reached.

Once you have your application(s) and check completed and ready, you may

WHEN?:

Assuming the required 200 applications and prepayment fees are
collected, the process will move to the tag approval stage. The
University will have to approve a specific logo for placement on the
specialty tag, and this will require some coordination between the State
Tax Commission and the University’s legal department. Once a logo has
been approved, the State Tax Commission will authorize the creation of
an exemplar plate for review and approval. We anticipate at this time
that the logo will be the classic “Charging Elephant through the ‘A’”
with which we are all familiar.

After the logo is approved and the prototype tag approved, production of
the actual tags will begin. Each applicant will be notified by the
State Tax Commission at the time their specialty plate is mailed to
their respective county tax collector. Each applicant will then be
required to take their existing tag(s) to their tax collector’s office
to exchange for their new plate.

This process may take some time, so please be patient. The sooner we
collect the target number of 200 applications and prepayment fees, the
sooner we can move to tag approval and production.

What if the target number of 200 falls short? If in the unlikely event
there is insufficient participation to have a specialty tag approved,
Craig Slay has agreed to take the responsibility of returning the
prepayment fees being held in escrow to each applicant.
